Vorweg sei angemerkt, dass das Buch keinen "allgemeinen Teil" hat. Es werden also nicht zunächst allgemeine Erkenntnisse der ökonomischen Analyse (Effizienzprinzip u.a.) vorangestellt.
Stattdessen geht es sogleich in medias res, indem die Erkenntnisse für verschiedene Rechtsbereiche dargestellt werden. Es handelt sich dabei um eine brennspiegelartige Zusammenfassung des bisherigen wissenschaftlichen Lebenswerks des Autoren Shavell, der in vielen Rechtsbereichen die ökonomische Analyse vorangebracht hat. Viele Erkenntnisse seiner wegweisen Aufsätze stellt er hier in einen umfassenden Kontext, ordnet sie übergeordneten Begriffen zu, und stellt wichtige Querverbindungen her. Schwächen vermag ich nicht zu erkennen. Das deliktsrechtliche Kapitel (Seiten 175 ff.) ist sicher eine besondere Stärke, da Shavell hier in seiner bisherigen Arbeit deutliche Forschungsschwerpunkte gesetzt hatte. Aber das eingehende sachenrechtliche Kapitel (Property Law) der Seiten 7 ff. ist annäherend genauso stark. Im zivilprozessualen Kapitel hätte ich mir vertiefende Auseinandersetzungen etwa mit den verschiedenen Ansätzen der erfolgsabhängigen Rechtsanwaltsvergütung (lodestar vs. percentage-of-the-fund) gewünscht.
Anlass für Kritik dürfte allerdings geben, dass das Werk seine Grundannahmen (Akteure handeln nach dem Muster des Homo oeconomicus zur Eigennutzmaximierung) weder genauer erklärt, empirisch rechtfertigt, geschweige denn kritisch hinterfragt. Natürlich dürfte diese Kritik nicht den Schwerpunkt eines Grundlagenwerks zur ökonomichen Analyse bilden, aber es hätte sicher nicht geschadet, wenn Shavell an einigen Schlüsselstellen die Kritik am ökonomischen Rationalitätsmodell aufgezeigt hätte.

La structure du bouquin est assez classique mais il a l'avantage de consacrer une partie dans laquelle il discute l'idée de fairness, ce qui n'est pas pour déplaire au juriste français.
Une fois de plus, Monsieur Shavell a frappé.
Many of the theoretical examples include numerous "if" statements, but he frequently fails to help the reader consider the outcomes if one or more of the assumptions are relaxed.
In other examples he altogether ignores opportunity cost - one of the most fundamental concepts in economic analysis.
At other times he labels his opinions as facts so as to give his preferred policy prescriptions more weight than they deserve.
This all adds up to a systematic pro-State, anti-market bias in assumptions, examples and analysis. Shavell masterfully does all this in a manner so subtle that it goes unnoticed by most readers. I'm giving the book 1 star not because it is poorly written, but because it is a normative dissertation posing as positive analysis.
